Motion Hearings To Continue

October 17, 2007 - Attorneys Mickey Homsey, Hank Meyer, David Autry & Terry McMillan were back in Grady County court yesterday in front of Judge C. Allen McCall for motion hearings for defendants Sheriff Kieran McMullen, Helen McMullen and Robert Cacy.  The defense called OHP Trooper Glen Zink to the stand. He testified that he was aware of the games at the Chickasha Elks Lodge, as well as similar machines being in the bowling alley and several convenience stores in the area. He stated that he was unaware that the machines were illegal. Trooper Zink also testified that former deputy Jason Carpenter, (now with Drug Court), had invited him to a private poker game at the home of District Attorney Bret Burns. Trooper Zink said that he declined as he doesn’t gamble. 
Judge McCall did not rule on the motions but instead took them under advisement. The attorneys are scheduled to have a conference call with Judge McCall today to schedule more dates for hearings. We will publish those dates as soon as they become available. 
Dates to note: According to the docket published by the Grady County Courthouse, 
  • John Moddrell’s trial for Intimidation of a State’s Witness is due to begin Thursday, November 1, 2007 at 9:00 am. 
  • Bill Swanson’s trial for Willful Neglect of Duty is scheduled for Jury Term October 22, 2007 – November 2, 2007. (A more specific date was not published.)
